These Terms of Use ("Terms") govern your access to and use of the Jukeboxy Service, operated by Creative Music Solutions, LLC, doing business as Jukeboxy ("Jukeboxy," "we," "us," or "our").
The Jukeboxy Service is a browser-based, subscription music platform designed for business use. It includes both playback and management tools accessed through desktop or mobile web browsers.
By accessing or using the Jukeboxy Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

Together, these components form a single integrated SaaS offering. Use of either the Web Player or the Dashboard constitutes use of the Jukeboxy Service and is governed by these Terms.
No software download or installation is required. Availability and functionality may vary based on browser, device, network conditions, and subscription level.
You must be at least 18 years old and authorized to act on behalf of a business to use the Jukeboxy Service.
Access to the Service requires an active Jukeboxy account. You are responsible for safeguarding your login credentials and for all activity conducted through your account, including actions taken by authorized users you invite or permit access to.
You agree to provide accurate, current, and complete account information and to keep it updated.
Subject to these Terms and an active subscription, Jukeboxy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Jukeboxy Service solely for music playback and management within your licensed business premises.
Subscriptions are licensed based on how music is streamed within a single physical address:
Each subscription or zone license applies only to the physical address associated with the account.

Unauthorized use beyond the licensed scope constitutes a material breach and may result in immediate suspension or termination without refund.
Jukeboxy subscriptions include public performance licensing for background music use through applicable performing rights organizations:
This coverage applies only to licensed background or foreground music use within the subscribed location.
Licensing does not cover:
You are solely responsible for obtaining additional licenses if your use falls outside the permitted scope.
All features of the Jukeboxy Service require a paid subscription. Jukeboxy may offer a one-time fourteen (14) day free trial at its discretion to allow businesses to evaluate the Service.
During the free trial:
After the trial ends, continued use of the Service requires an active paid subscription.

The Jukeboxy Service, including all software, playlists, audio streams, interfaces, trademarks, and content, is owned by Jukeboxy or its licensors and is protected by intellectual property laws.
Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from any part of the Service.
Your use of the Service is subject to Jukeboxy's Privacy Policy. By using the Service, you consent to the collection and processing of your information in the United States.
The Service is provided "as is" and "as available." Jukeboxy disclaims all warranties to the fullest extent permitted by law.
To the maximum extent permitted by law, Jukeboxy will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
Any legal action or proceeding arising out of or relating to the Jukeboxy Service shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction and venue of such courts.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
